According to current regulations, the maximum duration of a work permit application is 02 years and can be extended.
To get a foreign work permit in Vietnam. Workers need to pay attention to the following:
I. APPLICATION DOCUMENT FOR A WORK PERMIT
- Written request for a work permit from the employer (company based in Vietnam)
- Health certificate (valid for 12 months, from the date of signing the health conclusion to the date of submitting the application)
- Criminal record card proving that the employee has not violated the law (valid for no more than 06 months, from the date of issue to the date of application submission)
- Documents and documents proving that you are a manager, executive director, expert, or technical worker:
– As a manager and executive director, the head and deputy head of an organization. Specifically, the company charter and company operating regulations; business registration certificate; resolution or appointment decision.
– Experts are workers who have graduated from university or higher and have at least 03 years of working experience suitable for the expected job position in Vietnam.
– Technical workers are workers who have been trained for at least 01 year and have at least 03 years of work experience suitable for the job position they are expected to work in Vietnam or have at least 05 years of work experience suitable for the position. expected work in Vietnam
- 02 color photos (size 4cmx6cm), white background, no glasses, straight face, bare head, photos taken no more than 06 months before the date of issue
- Document approving the need to employ foreign workers
- Certified copy of passport
- Other documents related to foreign workers working in Vietnam. Depending on the form such as internal business transfer, implementation of labor contract, contract service provider, etc.
Note: Documents (health certificate, criminal record, documents proving professional qualifications, documents confirming work experience, personnel appointment decisions, etc.) are certified copies. , if it is from a foreign country, it must be consularly legalized; Translated into Vietnamese and authenticated according to Vietnamese law.
II. STEPS IN MAKING A WORK PERMIT
Step 1: The company carries out procedures to announce employee recruitment on the website of the Employment Service Center.
Step 2: Apply for written approval to employ foreign workers at the Department of Labor, War Invalids and Social Affairs or the Department of Employment
Step 3: Submit application for work permit
The time to do all 3 steps is about 2 months.
IMPORTANT NOTES:
– The actual time for completing work permit procedures will be longer than the time given by the agency receiving the work permit application.
– Employees should request the company in Vietnam to do steps 1 and 2 in parallel with the employee preparing documents for a work permit. In fact, these two steps are the most time consuming.
– Documents that can be done in Vietnam should be done in Vietnam to save time and costs rather than doing it abroad.
– Depending on each case, the application for a work permit will be different. The content of foreign documents such as qualifications and experience confirmation is especially important in determining whether the application is approved by Vietnamese state agencies or not? Therefore, workers should contact the service unit for accurate advice on this content. Avoid the situation where foreign documents are completed and when brought back to Vietnam, they cannot be used because the content is not approved by Vietnamese state agencies.
