Special cases are not subject to work permit issuance

If the employee falls into one of the special cases below, he or she is not eligible for a work permit. Instead, procedures must be carried out to confirm that foreign workers are not subject to a work permit.

I. CASES WHERE CERTIFICATION IS NOT SUBJECT TO THE WORK PERMIT ISSUANCE ELECTRICITY

  1. Foreigners marry Vietnamese and live in Vietnamese territory
  2. Be the Head of a representative office, project or be primarily responsible for the activities of international organizations and foreign non-governmental organizations in Vietnam.
  3. Entering Vietnam for a period of less than 3 months to handle incidents or complex technical and technological situations that affect or threaten to affect production and business that Vietnamese experts and Foreign experts currently in Vietnam cannot handle it.
  4. In cases under the provisions of international treaties to which the Socialist Republic of Vietnam is a member.He/she is an intra-company transferee within 11 sectors in the schedule of commitments in services between Vietnam and WTO, including: business services, communication services, construction services, distribution services, educational services, environmental services, financial services, health services, tourism services, recreational and cultural services, and transport services.
  5. He/she enters Vietnam to provide professional and engineering consulting services or perform other tasks intended for research, formulation, appraisal, supervision, evaluation, management and execution of programs and projects using official development assistance (ODA) in accordance with regulations or agreement in international treaties on ODA signed between the competent authorities of Vietnam and foreign countries.
  6. He/she is granted a communication and journalism practicing certificate in Vietnam by the Ministry of Foreign Affairs as per the law.
  7. He/she is sent by a foreign competent authority or organization to Vietnam to teach and study at an international school under management of a foreign diplomatic mission or the United Nations; or of a facility established under an agreement to which Vietnam is a signatory.
  8. He/she is a volunteer.
  9. He/she enters Vietnam to implement an international agreement to which a central or provincial authority is a signatory as per the law.
  10. He/she is a student studying at a foreign school or training institution which has a probation agreement with an agency, organization or enterprise in Vietnam; or a probationer or apprentice on a Vietnam sea-going ship.
  11. He/she obtains an official passport to work for a regulatory agency, political organization, or socio-political organization..
  12. He/she takes charge of establishing a commercial presence
  13. He/she is certified by the Ministry of Education and Training as a foreign worker entering Vietnam for teaching and research purpose.

 

II. COMPONENTS OF THE CONFIRMATION DOCUMENT ARE NOT SUBJECT TO ISSUANCE OF A WORK PERMIT

1 Written request to confirm that foreign workers are not subject to a work permit;

2 Health certificate or health examination certificate (valid for 12 months, from the date of signing the health conclusion to the date of submitting the application);

3 Document approving the need to use foreign workers, except in cases where the need to use foreign workers is not required;

4 Certified copy of passport or copy of passport certified by employer;

5 Documents to prove that foreign workers are not subject to a work permit;

Note: The documents specified in contents 2, 3, 5 above are certified copies. If they are from foreign countries, they must be consular legalized, translated into Vietnamese and notarized or authenticated.

When a foreigner has been granted a temporary residence card, he or she has the right to sponsor a temporary residence card for his wife and minor children in Vietnam to ensure the right to legally reside, work and live in Vietnam.

If foreigners come to Vietnam for a short term to work, applying for a business visa is the right choice. At the end of the visa term, foreigners who have not completed their work and want to continue to stay can extend their visa.
